Collaborative law on the rise, attorney says

Lawyers are using a more collaborative approach to help divorcing clients resolve family business issues.
Attorney Robert Merlin in Coral Gables said the serious consequences that divorce can have on family owned businesses often make collaborative divorce in all parties' best interest.
Collaborative law, established in the 1990s, helps couples resolve differences using a non-adversarial collaborative divorce that aims to save time, energy and money.
The process employs neutral forensic accountants to review a family's business, assets, income, liabilities and debt. They work with lawyers to settle economic issues, leaving essential time for personal issues.

Last month, Chief Judge Joseph P. Farina of Florida's Miami-Dade Circuit Court signed an administrative order authorizing the collaborative model of family law to be used in that court. Proponents say collaborative divorces are cheaper and faster, and easier on children. Miami-Dade's collaborative practice will differ from West Coast models because if the parties can't reach an agreement, then their collaborative attorneys will have to drop out and each party must find divorce lawyers.
